Using Flexable

Flexable helps clients and independent professionals find each other, discuss work, agree on a scope and, where available, manage payment and delivery in one place.

You must be legally able to enter into contracts in your jurisdiction. If you use Flexable for a company or other organisation, you confirm that you have authority to act for it.

Accounts

Keep your account information accurate and your sign-in credentials secure. You are responsible for activity carried out through your account unless you promptly tell us about unauthorised access.

We may ask for information needed to verify identity, professional details, payment information or eligibility to use certain features.

Projects and agreements

Before work starts, clients and freelancers should agree on the important parts of a project, including the scope, price, timeline, deliverables and any revision or ownership terms.

The project agreement is between the client and the freelancer. Flexable may help structure the brief, recommend talent, keep the conversation moving and record the agreed terms, but each party remains responsible for what it promises and delivers.

Matches, recommendations and availability checks are intended to reduce search effort. They are not a guarantee that a person will be suitable for every project or that a project will have a particular outcome.

Fees and payments

If a project uses Flexable payments, the amount, applicable Flexable fees and any relevant payment terms will be shown before you confirm payment.

You authorise Flexable and its payment providers to process the transactions you approve. Payment processing may be subject to additional terms from the payment provider.

Clients and freelancers are responsible for their own taxes, filings and reporting unless applicable law requires Flexable or a payment provider to collect, withhold or report them.

Cancellations, refunds and disputes

Cancellation, revision and refund rights depend on the project terms and any protection shown for that transaction. Where Flexable offers a project-protection or dispute process, the applicable rules will be presented before or during the transaction.

If something goes wrong, both parties should first try to resolve it through the project conversation. Flexable may review the brief, messages, agreed scope, delivery evidence and payment records when helping with a dispute.

Content and intellectual property

You keep ownership of content you upload to Flexable. You give Flexable a limited licence to host, display, process and use that content only as reasonably needed to operate, secure and improve the service.

Ownership of project deliverables should be agreed between the client and freelancer. Flexable does not automatically transfer intellectual-property rights between users.

Do not upload material you do not have the right to use or share.

Acceptable use

Use Flexable professionally and lawfully. You may not:

• misrepresent your identity, experience, work, reviews or authority;
• post unlawful, infringing, deceptive or harmful content;
• harass, threaten, discriminate against or exploit another user;
• interfere with the service, bypass security controls or access data you are not authorised to access;
• use automated means to scrape, copy or extract substantial parts of Flexable without permission; or
• use Flexable to facilitate fraud, money laundering or other illegal activity.

Profiles and rankings

Public profiles and rankings may use information supplied by users together with signals Flexable verifies or derives from professional activity. Rankings can change as information changes, new talent becomes eligible or the methodology is updated.

A ranking is an editorial and product signal, not a certification, employment reference or guarantee of performance. Flexable may correct, remove or withhold profile information that is inaccurate, misleading or cannot be verified.

The Flexable platform

We may add, change or remove features as the product evolves. We try to keep Flexable reliable and secure, but we do not promise uninterrupted or error-free access.

Some features rely on third-party services such as identity, communication, hosting or payment providers. Those services may have their own terms and privacy practices.

Flexable’s name, product design, software and other platform materials are owned by or licensed to Flexable and may not be copied or used outside the permissions these Terms give you.

Disclaimers and liability

Flexable provides the platform and related services on an “as available” basis. To the extent permitted by law, we do not make warranties that are not expressly stated in these Terms or in a specific paid service agreement.

To the extent permitted by law, Flexable is not responsible for indirect, incidental or consequential loss, or for losses caused by another user’s conduct, project performance or information. Any mandatory rights or liabilities that cannot legally be excluded remain unaffected.

Suspension and termination

You may stop using Flexable at any time. We may restrict or suspend access where reasonably necessary to protect users, investigate abuse, comply with law, address unpaid amounts or enforce these Terms.

Ending access does not cancel obligations that already arose from a project, payment, dispute or intellectual-property agreement.

Changes to these Terms

We may update these Terms as Flexable changes or when legal requirements change. When an update is material, we will provide reasonable notice through the product, website or another appropriate channel.

Your continued use after an updated version takes effect means the updated Terms apply from that date.

Governing terms and contact

These Terms are governed by the laws applicable to the Flexable operating entity that provides the service to you, subject to any mandatory rights that apply in your jurisdiction.
